Welcome to TraderKit One ("TraderKit", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the TraderKit One mobile application and associated software (collectively, the "App" or "Services").

By downloading, installing, logging in, or using TraderKit One, you ("User", "Trader", "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

1. Description of Services & Architecture

TraderKit One is a high-performance, client-side algorithmic trading assistant, quant analytics platform, and visual bot automation interface. The App enables users to:

  • Connect directly to the Deriv trading platform via official OAuth 2.0 and Secure WebSocket (WSS) APIs;
  • Analyze real-time synthetic index digit distributions, repeat streaks, hot/cold digit frequencies, and quant indicators;
  • Execute manual synthetic index contracts (Matches/Differs, Over/Under, Even/Odd, Higher/Lower);
  • Configure and run automated trading strategy bots (such as Differ Scout, Momentum Follower, Match Scalper, Even/Odd Trend, and custom rule engines) with configurable money management models (Martingale, D'Alembert, Fixed Stake);
  • View real-time open positions, contract settlement streaming, and transaction summaries.

2. Independent Software — No Brokerage or Custodial Relationship

  • Independent Client: TraderKit One is an independent third-party client interface and is not an affiliate, subsidiary, or official representative of Deriv Services Ltd or Deriv Ltd.
  • No Custody of Funds: TraderKit One never holds, receives, processes, or custodies your funds, deposits, or withdrawals. All financial transactions, trading accounts, account balances, and contract settlements are executed and held exclusively by Deriv.
  • No Brokerage Services: TraderKit One is solely a technological software tool. We do not act as a financial broker, dealer, investment manager, or payment processor.

3. Direct Connection & Zero Server Storage

  • Direct-to-Broker Communication: All market data requests, tick streams, proposal quotes, trade executions, and balance queries communicate directly from your device to Deriv's official API servers.
  • Local Storage: Your bot configurations, risk thresholds, custom parameters, and session preferences are stored locally on your device. We do not store your trading credentials, account keys, or trade history on any centralized TraderKit servers.

4. Financial & High-Risk Investment Disclaimer

TRADING DERIVATIVES, SYNTHETIC INDICES, AND VOLATILITY CONTRACTS CARRIES A HIGH LEVEL OF RISK AND CAN RESULT IN THE SUBSTANTIAL OR TOTAL LOSS OF YOUR CAPITAL.

  • No Financial Advice: Any strategies, quantitative metrics, bot presets, technical indicators, or historical stats provided within the App are for educational and automation purposes only and do not constitute financial, investment, legal, or tax advice.
  • Automated Trading Risks: Algorithmic bots and automated money management strategies (such as Martingale or compounding multipliers) can rapidly increase position sizes during consecutive losing streaks, potentially resulting in rapid capital drawdown.
  • User Responsibility: You are solely responsible for evaluating your risk tolerance, configuring appropriate Stop-Loss and Take-Profit limits, and determining whether derivative trading is suitable for your financial situation.
  • Simulated & Virtual Trading: We strongly recommend testing all bot strategies and risk parameters on a Deriv Virtual (Demo) account before committing real funds.

5. Eligibility & Account Security

  • Age Requirement: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and legally capable of entering into binding contracts.
  • Jurisdictional Compliance: You are responsible for ensuring that accessing and using derivative trading software complies with the laws and regulations of your country of residence.
  • Credential Protection: You are solely responsible for safeguarding your device, account passwords, and authorization tokens. TraderKit is not liable for unauthorized trades executed through your device.

6. Connectivity, Execution & Device Responsibilities

  • Network Stability: Automated bot execution and live position tracking require an active, stable internet connection. TraderKit is not responsible for execution delays, slippage, failed orders, or missed stop-loss triggers caused by mobile network disconnects, latency spikes, or battery saver throttling.
  • Keep-Awake Functionality: When running automated bots, you are responsible for maintaining device battery and keeping the application active during live runs.

7. Acceptable Use Policy

You agree not to:

  • Reverse engineer, decompile, disassemble, modify, or attempt to extract the source code of the App;
  • Interfere with or disrupt the integrity or security of the App or Deriv APIs;
  • Use the App for market manipulation, fraudulent activities, or in violation of Deriv's API Terms of Service;
  • Resell, redistribute, rent, or lease the App to third parties without prior written authorization.

8. Disclaimer of Warranties ("AS IS")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • TRADERKIT ONE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
  • WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UPTIME, PROFITABILITY, OR NON-INFRINGEMENT.
  • WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR IMMUNE TO SERVER OUTAGES OR API CHANGES ENACTED BY DERIV.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IN NO EVENT SHALL TRADERKIT ONE, ITS CREATORS, CONTRIBUTORS, DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF TRADING PROFITS, CAPITAL LOSSES, FINANCIAL DRAWDOWN, LOST OPPORTUNITIES, DATA LOSS, OR DEVICE MALFUNCTION) ARISING FROM YOUR USE OR INABILITY TO USE THE APP OR STRATEGY BOTS.
  • YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE APP IS TO STOP USING THE SERVICES.

10. Modifications to Terms & Services

We reserve the right to modify or update these Terms at any time. Any changes will be reflected with an updated "Last Updated" date in the App. Continued use of TraderKit One after changes are posted constitutes acceptance of the revised Terms.
